What is iTrustCapital's role in securing my account and assets?
iTrustCapital is a software platform and IRA provider that utilizes state-regulated Qualified Custodians to maintain a regulatory structure and added security to all of its accounts.
What is a Qualified Custodian? Who are they regulated by?
Under Section 408 of the Investment Advisors Act of 1940, the SEC defines a Qualified Custodian generally as a Bank or Trust Company that provides safe custody of client assets and handles all reporting and reconciliation of client accounts.
For our IRAs, Fortis Bank is the Qualified Custodian, and they are the entity that has all the licenses required to custody these asset classes. They are state-chartered out of Colorado as a Trust entity, and they are not a Broker/Dealer. Fortis-held assets are NOT “on balance sheet”. All assets are held FBO (“for benefit of”) and segregated for each customer.
Who regulates my IRA?
IRAs are regulated by the IRS.
Who regulates my PCA?
For our non-retirement (PCA) accounts, iTrust Custodial Services is the Qualified Custodian. ICS is regulated in New Mexico.
Who provides and regulates the commodities I hold with iTrustCapital?
All commodities are regulated by the CFTC, which includes crypto and precious metals.
We utilize Coinbase Custody, Fidelity Digital Assets, and Fireblocks for the custody of cryptocurrency.

Precious metals are sourced by Kitco. Transactions are ledgered on the blockchain through our partner Tradewind using their program called VaultChain that digitizes the buying and selling, settlement, & ownership of gold and silver.

Who provides and regulates the commodities I hold with iTrustCapital?
The securities on the platform are provided by our Broker-Dealer partner, APEX. All stocks and ETFs are regulated by FINRA and the SEC.
Who regulates iTrustCapital's banking partners?
All iTC banking partners are regulated by the OCC and/or FDIC.
